Terms & Conditions

🟥 IMPORTANT – LEGAL & REGULATORY NOTICE

This Agreement is a commercial agreement between Wizz Cabs and an independent self-employed Driver/Operator. It is not intended to create an employment relationship.

The Driver is responsible for maintaining all licences, authorisations, insurance, vehicle compliance, taxation obligations and regulatory requirements applicable to the Driver's operations.

The Driver must comply with all applicable Western Australian laws, including the Transport (Road Passenger Services) Act 2018, the Transport (Road Passenger Services) Regulations 2020, applicable Department of Transport / DTMI requirements, road laws, safety requirements, disability discrimination requirements, vehicle requirements and any other applicable legislation, standards or lawful directions.

Where legislation, regulation, government direction or an official requirement changes, the Driver must comply with the requirement as amended, regardless of whether this Agreement has subsequently been updated.

1. INDEPENDENT CONTRACTOR STATUS

The Driver operates as a self-employed independent contractor and is responsible for conducting the Driver's business in accordance with applicable law.

Nothing in this Agreement is intended to create:

  • an employment relationship;
  • a partnership;
  • a joint venture;
  • an agency relationship except where expressly required for the provision of booking services;
  • or any other relationship inconsistent with the Driver operating as an independent contractor.

The Driver is responsible for the Driver's own business expenses, taxes, statutory obligations, licences, insurance and regulatory compliance.

The Driver acknowledges that the Driver assumes responsibility for the lawful operation of the vehicle and the services personally performed by the Driver.

2. RANK / NETWORK SUBSCRIPTION FEES

🔵 2.1 Monthly Subscription

Access to Wizz Cabs' network, designated taxi ranks, dispatch services, booking systems and associated commercial facilities may be subject to a monthly subscription or rank fee.

The applicable fee must be paid in advance on or before the agreed monthly due date.

If a required subscription, rank fee or other agreed commercial charge remains unpaid after the applicable due date, Wizz Cabs may, subject to applicable law and the terms of this Agreement:

  • suspend network access;
  • suspend dispatch access;
  • deactivate or restrict access to Wizz Cabs equipment or systems;
  • suspend access to designated ranks where Wizz Cabs is legally entitled to control such access; and
  • recover the outstanding amount from monies otherwise payable to the Driver, where legally permitted.

No suspension or system action will authorise the Driver to operate unlawfully or without the licences, authorisations or equipment required by law.

Booking collections processed through Wizz Cabs may include:

  • electronic/card payments;

⚠️ DRIVER RESPONSIBILITY

The Driver is personally responsible for ensuring that the 12-hour maximum is not exceeded.

Wizz Cabs dispatches, bookings or system availability do not authorise the Driver to exceed a lawful or contractual working limit.

If the Driver becomes fatigued or otherwise unfit to drive safely, the Driver must stop operating immediately, regardless of whether 12 hours has been reached.

SAFETY ALWAYS OVERRIDES COMMERCIAL TARGETS, BOOKINGS OR REVENUE.

6. METER & FARE INTEGRITY

Important: I deliberately changed the wording from “all fines will be charged to the Driver” to “the Driver is responsible for fines/infringements arising from the Driver's conduct, to the extent permitted by law.” That is safer contract drafting because a private agreement cannot simply transfer every statutory liability or government penalty regardless of what the legislation says.
